London’s Theme Song 2.0
Official Contest Rules


1.The “London’s Theme Song 2.0 ” contest (hereinafter: the “Contest”) is brought to you by Astral Radio, (hereinafter: the “Contest Organizers”). The Contest runs on Newstalk 1290 CJBK  in London, Ontario, Canada from January 18th , 2012 to March 9th ,  @ 12PM noon  2012 (hereinafter: the “Contest Period”).
a.    The London Theme Song 2.0 Submission period commences at approximately 9:00 am, on January 18th, 2012 and Newstalk 1290 CJBK will conclude accepting entries at 12:00 pm(Noon) on March 9th ,12PM, 2012. All entries received after this time will be considered invalid.
b.    All submissions will be available to be viewed from approximately 9.00am January 18th, 2012 until 12.00 pm on Friday, March 9th, 2012.
c.    On Monday, March 12th , 2012 the top ten (10) will be posted.
d.    The grand prize winner will be posted to Newstalk 1290 website on March 19th ,2012. The Grand prize winner will also be contacted by London in the Morning Host Steve Garrison between 7-9am on March 19, 2012.

ELIGIBILITY
2. This Contest is open to all persons residing in Ontario, Canada who have reached the age of majority as of the first day of the Contest Period. After the first entry received, any subsequent submission by the same person will be disqualified. Notwithstanding the preceding, the Contest is not open to individuals associated with the Contest, including the employees, agents and representatives of the Contest Organizers, (including their respective divisions, subsidiaries, affiliates and agencies), their advertising and promotional agencies, suppliers of prizes, materials and services related to this contest or any other party directly linked to the holding of this Contest (the “Excluded Individuals”). This Contest is also not open to the immediate family members of the Excluded Individuals. For the purpose of these Contest Rules, “immediate family” includes: father, mother, brothers, sisters, children, legal or common-law spouse and individuals with whom such employees, agents and representatives reside.
    
 ELIGIBILITY: You agree that all  submissions and materials that you submit you assume total and exclusive responsibility and liability for the content thereof and the use thereof. Astral Radio has the right to use your  submission on our site as well as for marketing purposes for an unlimited time frame. You also agree that you will not upload content that is or may be threatening, profane, harassing, defamatory, unlawful, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or which may give rise to civil or criminal liability under any applicable law. You further agree that you will fully indemnify and hold Astral  Radio harmless of, from and against any liability, loss, damages, costs and attorneys fees that may be alleged against or incurred by Astral Radio  as a result of any and all claims by third parties or law authorities related in any manner to your photos and materials or the use thereof regardless of whether or not Astral Radio pre-screens your content. Astral Radio reserves the right to edit or remove content which violates or which they reasonably believe violates any of the foregoing provisions or any law.

HOW TO ENTER

3. No purchase necessary. To enter, you must comply with the eligibility criteria set out in these Contest Rules within the Contest Period. To qualify, enter the required information in a form on the web at the London site of Newstalk 1290 CJBK. The submission will then go through a screening process to insure that it complies with the eligibility criteria set out in these Contest Rules, during the Contest Period. This screening process could take up to 48 hours. Once deemed eligible, the submission will be posted at www.cjbk.com.

Entries will not be eligible if sent by any method not specified above or if received after the conclusion of the specific entry period in the Contest Period.

By providing the entry elements described above, and officially entering this Contest, you agree to accept and acknowledge the rules, regulations, restrictions and prize description "as is."

Entrants must agree, if they are selected as the Grand Prize Winner that they will not grant interviews to other media outlets, including but not limited to television, magazine, newspapers, cable, radio, and Internet, unless authorized in advance in writing by Newstalk 1290 . They also agree to act as ambassadors for the purpose of promoting Newstalkl 1290  and the participating sponsors in a complimentary manner at all times.

SELECTION METHODOLOGY: All eligible entries will be ultimately selected by an impartial panel of judges from the entry phase of the Contest. The decisions of the judges are final and entrants agree to be bound by these decisions.

As a condition of continued eligibility, The Grand prize winner will be required to complete and sign an Affidavit of Eligibility, Waiver of Liability and a Publicity Release. They may be asked to attend a mandatory photo session, date, time and location to be determined.

Thereafter, submissions  of the 10 (ten) and a brief profile ("Profile") prepared by Newstalk 1290  in its sole discretion regarding each of the submissions will be placed on Newstalk 1290   website www.CJBK.com.Finalists will have no opportunity to review, edit, or comment on their Profile prior to its publication BX93 may elect in its sole discretion to edit or correct a Profile after it has been posted.

VOTING METHODOLOGY: The Grand prize winner of the prize will be determined during the final voting round from our impartial panel of judges and Newstalk 1290  listening audience. In the event of a tie Newstalk 1290  will determine the winner.

The grand prize winner will be announced be posted to www.CJBK.com on Monday, March 19, 2012.

In order to be declared a winner, a potential winner must: (i) be in compliance with these Contest rules; (ii) complete, sign and return a Astral Radio form declaration and release prepared by Astral Radio before being declared a winner and before a prize will be released; and (iii) correctly answer, without mechanical aid or assistance, a mathematical time-limited skill testing question set out in the Astral Radio form declaration and release.

If a potential or declared winner is not in compliance with these official Contest rules and regulations, Newstallk 1290  reserves the right to disqualify such entrant from the Contest, Newstalk 1290   reserves the right to determine an alternate winner or not award the prize, at its sole discretion.

Odds of winning depend on the total number of eligible online entries received during the Contest entry period and the number of votes received during the Contest voting period.

PRIZE[S] DESCRIPTION

4. The following prize is offered:  1000.00 cash
8 hours studio time at Charterhouse Studios – session players are available and will be part of the prize should the grand prize winner need musicians, however, no cash will be refunded to grand prize winner should session players not be required.

The elements of the prize are non-transferable, redeemable for cash or exchangeable for any other prize. In the event an element or component is unavailable for any reason, Newstalk 1290  and participating sponsors reserve the right to substitute a different element or component in their sole discretion.
The prize elements will be awarded as described herein (subject to legal restrictions).

All expenses other than those specifically mentioned above as included shall be assumed by the winner. Any modifications or additions desired by the winner will result in an added expense to the winner and are not the responsibility of Newstalk 1290 or any of the Contest sponsors.

If the winners choose not to accept any elements awarded as part of this prize package, the winners understand that Newstalk 1290  or any of the Contest sponsors are not required to offer replacement elements. Furthermore, Newstalk 1290  and all the Contest sponsors are not responsible for any difficulties of any kind whatsoever experienced by the winning winner due to modifications they make to the prize(s) awarded.

5. By entering the Contest, each entrant agrees to abide by these Contest Rules. In the event the potential or declared contestant fails to comply with any one of the conditions set out above or any other conditions set out in these Contest Rules, the Contest Organizers reserve the right to disqualify such entrant from the Contest and if time allows, a new draw for the contestant will be held in accordance with these Contest Rules, until an contestant is selected.

HOW TO CLAIM A PRIZE
6.    Within five (5) days following the moment the contestant is declared a winner the Contest Organizers will inform the winner on how to take possession of their prize. In the event the winner fails to collect his or her prize in accordance with the instructions set out in this paragraph, the winner will forfeit the right to collect the prize, and the Contest Organizers reserve the right to withdraw the prize entirely, with no further obligation to award such prize in any additional draws.

GENERAL CONDITIONS
7.    VERIFICATION.
Entry Forms are subject to verification by the Contest Organizers. Any Entry Form which is incomplete, incomprehensible, inaudible, illegible, fraudulent, mutilated, altered, contains false information or is not received within the Contest Period, or otherwise does not confirm to these Contest Rules will automatically be rendered invalid and will not entitle such entrant to be eligible for a prize.

8.    DISQUALIFICATION. The Contest Organizers reserve the right to disqualify any person or cancel one or more entries of any person participating in this Contest or trying to participate by means contrary to these Contest Rules or in a manner which is unfair to other entrants (e.g.: use of an Entry Form obtained from an unauthorized source, entries exceeding the limit allowed, computer hacking, etc.). Any attempt to tamper with the entry process, interfere with these Contest Rules, deliberately damage any website or undermine the administration, security or legitimate operation of the Contest, is a violation of criminal and civil laws and the Contest Organizers reserve the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future contests. Such person may be referred to the appropriate judicial authorities.

9.    NON-COMPLIANCE/ELIGIBITY.
If a potential or declared winner is not in compliance with these Contest Rules, the Contest Organizers reserve the right to disqualify such entrant from the Contest and randomly select further entrants from the remaining eligible entries until a winner is finally declared. Any potential or declared winner, who is not in compliance with these Contest Rules, must so inform the Contest Organizers immediately upon being contacted by the Contest Organizers.

10.    ACCEPTANCE OF PRIZE.
Prizes must be accepted as described in these Contest Rules and may not be transferred to another person, substituted for another prize, or exchanged in full or in part for cash, subject to the section below.

11.    SUBSTITUTION OF PRIZE.
In the event it is impossible, difficult and/or more costly for the Contest Organizers to award a prize (or part of a prize) as described in these Contest Rules, the Contest Organizers reserve the right to award a prize (or part of a prize) of similar nature and equivalent value or, at their sole discretion, the value of the prize (or of the part of the prize) in cash.

12.    REFUSAL OF PRIZE. The refusal by a potential or declared winner to accept any prize awarded in accordance with the Contest Rules, releases and forever discharges the Contest Organizers and their agents of all obligations related to the    prize, including delivery.

13.    LIABILITY LIMIT - USE OF PRIZE.
Each entrant and any potential or declared winner releases the Contest Organizers, their subsidiaries, respective divisions, their parent corporations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter: the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest or the acceptance or use of his/her prize. In order to be declared a winner and prior to obtaining his/her prize, any potential or declared winner agrees to sign a declaration to such effect in the Release Form. The
guest of a winner (or a parent or legal guardian in the case of a minor) will also have to sign such a declaration to that effect in the Release Form, failing which they will not be able to take part in the vacation.

14.    LIABILITY OF PRIZE SUPPLIER. Any person selected for a grand prize acknowledges that upon receipt of a letter confirming the prize, all services to be rendered in connection with their prize become the sole responsibility of the prize OR services supplier a declaration to such effect will be included in the Release Form.

15.    LIABILITY LIMIT - USE OF SOFTWARE. The Beneficiaries are not liable for faulty computer components, software, or links; the loss or non-existence of communications capability; or faulty, incomplete, incomprehensible, or erased computer or network transmissions that make it difficult, or render a user unable, to enter the contest; problems with any website or website feature howsoever caused, the malfunction of, or damage caused to, any telephone or network or lines, computer equipment, data or software, online systems, servers or access providers; or the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers” The Beneficiaries are not liable for any harm contestants may suffer directly or indirectly as a result of downloading any Web page or software or transmitting any information related to entry in the Contest.Further, the Beneficiaries assume no responsibility for entries lost, stolen, delayed, damaged or misdirected.

16.    WEB SITE ACCESS. The Beneficiaries do not guarantee access to or non-interruption of the Web site during the Contest Period or that it will be exempt from any errors.

17.    MODIFICATION. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the Contest as provided in these Contest Rules.

18.    LIMIT OF PRIZES. In no event shall the Beneficiaries be obligated to award more prizes than set out in these Contest Rules or to award prizes otherwise than in compliance with these Contest Rules.

19.     IMPOSSIBILITY TO ACT - LABOUR DISPUTE. The Beneficiaries shall not be responsible for any damages for a failure to operate the Contest in accordance with these Contest Rules in any case where their incapacity to act results from circumstances or a situation beyond their reasonable control or because of a strike, lock-out or any other labour dispute in their company or those of businesses which services are used for holding this Contest, war, riot, insurrection, earthquake, terrorism, civil commotion, fire, flood, accident, storm or any other act of nature.

20.    LIABILITY LIMIT - PARTICIPATION. Any person who participates or tries to participate in this Contest releases the Beneficiaries from any and all liability for damages which he/ she could suffer from participating or trying to participate in this Contest.

21.    AUTHORIZATION.
By entering this Contest, each declared winner consents to the Contest Organizers, their representatives to use, at their sole discretion and if required, their name, photograph, likeness, testimonial related to the prize, place of residence and/or voice without compensation whatsoever and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant. A declaration to such effect will be included in the Release Form.

22.    LIST OF WINNERS. From March 19  to November 23, 2012 a list of winners will be available at the office of the Station Monday to Friday from 9 a.m. to 5 p.m.

23.    PROPERTY OF ENTRIES. Entry Forms are the sole property of the Contest Organizers and at no time will be returned to entrants.

24.    COMMUNICATION OF ENTRANTS. No communication (other than while registering) or correspondence will be exchanged with entrants in the context of this Contest with the exception of selected entrants or declared winner.

25.    PERSONAL INFORMATION. Contestant personal information that is collected in this Contest will be used solely by the Contest Organizers, and their representatives for the administration of the Contest. There will be no communication of commercial or of any other nature, unrelated to this Contest sent to an entrant, unless such entrant gives specific authorization to the Contest Organizers for that specific purpose.

26.    DECISIONS OF CONTEST ORGANIZERS.
All decisions of the Contest Organizers or those of their representatives regarding this Contest are final and binding.

27.    IDENTIFICATION OF CONTESTANT. For the purposes of these Contest Rules, the entrant is the person whose personal information is printed on the Entry Form. It is to this person that the mathematical skill-testing question will be asked and the prize awarded if selected and declared a winner.

28.    UNENFORCABILITY. If a section of these Contest Rules is declared or ruled by a Court of Law as illegal, unenforceable or void, that section will be deemed void but all other sections not affected will be enforced as allowed by Law.

29.    JURISDICTION. This Contest is subject to all applicable federal, provincial and municipal laws.
